BCLQ launch was an exclusive invite to stakeholders to hear industry leaders talk about their involvement in body corporate topical issues and law reform with a unique opportunity to network.
Event Description
It was held in conjunction with the eminent global legal publisher, Wolters Kluwer CCH.
​The BCLQ practitioner’s Textbook launch brought together industry leaders and policy makers speaking on their involvement in the BC industry.
​Industry leading speakers provided their unique perspective on matters that directly affect their stakeholders, and matters that they have influence over, particularly in light of the reforms that sit on the horizon of the strata landscape.

​A discussion about the spread of strata titles throughout the world
About Gary:
Gary Bugden is the principal of Bugden Legal, a specialised body corporate legal practice in Brisbane. He is a former partner of Mallesons Stephen Jaques (now King & Wood Mallesons) and a long-time author of CCH/Wolters Kluwer, who published 3 loose-leaf services and 4 books that he wrote.
Gary has specialised in strata and community titles for over 40 years and during that time he has contributed to the ‘spread’ of strata titles throughout the world, having worked for Governments in Vietnam, Cambodia, China, England, Dubai, Abu Dhabi, Saudi Arabia, New Zealand, Fiji and Vanuatu.
As external consultant to Queensland Governments in the 1990’s he devised the leasehold system for the redevelopment of Brisbane’s South Bank and the current Modular system for community title schemes in Queensland. He also pioneered air-space development in Australia and introduced the ‘building management statement’ concept.
Summary:
Gary Provided a history of the development of Strata law in Australia and how Strata titling has taken many forms worldwide. Examples of complex and novel ways of strata titling were described as well as the need for strong legislative guidance to practitioners in Queensland.

​About James:
James Nickless specialises in all aspects of Strata Law and in his position as General Counsel is a valued member of the MaxSoft team.  James, a previous Partner at ClarkeKann Lawyers and Grace Lawyers, has served on the Legislation and Policy Committee of SCA (Qld) since 2013. James is passionate about advancing the Strata Industry and regularly presents seminars on various aspects of Strata Law and professional development to clients, industry groups and Universities, including the SCA A100 program.
Summary:
James focused on SCA’s role in delivering relevant training to Strata managers and the role that BCLQ will have in enhancing that training.

UDIA meeting increasing Strata development needs in light of law reform
About Ian:
Ian is the Regional Development Manager, Communities, for Lendlease. He has worked in the development industry for over 20 years with several corporate developers, including Australand, Urban Pacific and AVJennings in both Queensland and South Australia. Prior to this he was a consulting engineer providing services to the development industry for nearly a decade. Ian has been a UDIA member in both Queensland and South Australia, and served on the UDIA Queensland Board and committees for several years.
Summary:
Ian highlighted the ever-growing number of body corporates across Queensland and the importance of having a proper legal framework in order to have a better and more sustainable development.    ​

The importance of legislative compliance in strata title management rights
About John:
​
John is one of the founding partners of Mahoneys and is now the firm’s managing partner and head of the management rights and property law team. He was admitted as a lawyer in Queensland in 1978 and in New South Wales in 1990.
Since 1991 John has practiced extensively in body corporate law and predominantly in the area of management rights. John was heavily involved in the formulation of the 1997 legislation and subsequent reviews and amendments to the legislation.
Mahoneys has a significant litigation team with particular expertise in body corporate law. Significant disputes they have handled include the High Court Viridian Noosa Residences case.
John has also lectured in body corporate law at UQ for approximately 4 years.
Summary:
John provided advice in relation to the complexities associated with management rights, the need to ensure that agreements are carefully drafted and then interpreted. 
It was highlighted that practitioners often need to understand complex processes in the legislation when giving advice to clients.

Prof. Michael Weir

Perspectives on the nature of community title and legislation
About Michael:
Professor Weir entered academia with the faculty of law Bond University after broad experience as a solicitor in private legal practice in commercial and property law including strata title. In his academic career Professor Weir has published extensively on Land Law, Planning Law and Medicine and the law. Professor Weir is a co-author of the textbook Real Property Law in Queensland, LBC (4th edition, 2015). Professor Weir has been teaching land law for 28 years which included lectures and negotiation skills modules in relation to Strata Title.
Professor Weir recently published an article “Strata title, dispute resolution and law reform in Queensland” (2018) 26 Australian Property Law Journal based upon a paper presented at the 14th Australasian Property Law Teachers Conference 2017, Curtin University, Perth, September 2017.
Professor Weir has substantial experience as a company director and as a university manager including terms as Deputy Dean and Associate Dean (Research) for the faculty of law Bond University.
Summary:
Professor Weir provided an outline of the different elements that constitute a body corporate and highlighted the difficulties and disputes that can arise within Strata title arrangement. It was emphasised that body corporates are communities bound by a significant amount of legislations which is complex.

About Danny:
Danny has extensive experience in government, regulatory and environment law across a number of industry sectors, including major projects (mining, power and infrastructure), property development and local government.
Danny regularly advises clients on a variety of planning and environment issues including regulatory approvals, land resumption, contracting issues and compliance.
Danny is listed in Best Lawyers Australia 2016-2018 for Land Use and Zoning Law, Government Practice and Planning and Environment Law.

Danny provided practical case examples and highlighted time-frames and processes that practitioners must adhere to of interaction of other laws that impact on body corporates.

How BCLQ provides unprecedented access to this vital knowledge and understanding for all stakeholders, including, significantly, the growing number of unit owners in Queensland.​
About Ross:
Ross is currently Secretary/ Vice-President of the Unit Owners Association of Queensland (UOAQ).
He has been a member since 2002, becoming more actively involved when retirement allowed for closer attention to the issues being encountered by unit owners like himself.
Crucial to his understanding of these matters was the professional advice and guidance he received from the UOAQ.
Ross has become increasingly involved with helping other members of the UOAQ achieve sound management of their unit complexes, within the ambit of the law.
Summary:
Ross provided an overview of the changes and challenges that have undergone in Strata industry and noted the need for further and better education of Strata legislation particularly with Body corporate managers.
Ross also mentioned that Queensland is undergoing a significant growth in Strata titling and this needs informed and educated unit owners, either occupiers or investors, in order to have a smooth living experience for everyone in Queensland.

About Trevor:
Trevor Rawnsley is the CEO of ARAMA (Australian Resident Accommodation Managers Association) the not for profit peak industry body for people involved in Management Rights. Trevor will deliver practical insight into how effective the BCCM Act is in modern density living in Queensland.
Summary:
Trevor provided an outline of his experience of maintaining compliance for ARAMA stakeholders and in particular caretaker managers. He highlighted the inherent difficulties that caretakers face in discharging the contractual obligations. Trevor emphasised the complexities in the Law and the need for training of their stakeholders.

Digital disruption in the body corporate management industry
About David:
David Bugden is the Chief Commercial Officer (Strata) for ASX-listed technology company Urbanise. Urbanise are a leading provider of cloud-based software for the international strata management and FM industries.
David has over 20 years’ experience in the property, legal and technology sectors having held roles as a strata lawyer, development consultant, joint-CEO of a 25,000-unit strata business in Sydney and CEO of a Dubai-based property services company. Most of David’s career however has been running technology companies. In the late 1990’s, David developed Australia’s first internet-based (ASP) strata system in partnership with Wolters Kluwer CCH. He later implemented the industry’s first CRM system and then went on to become the Group CEO for 12 years for Mystrata.com, a cloud tech company specialising in strata management software that had offices in Australia, Dubai, South Africa and Malaysia.
David holds degrees in law and commerce and was admitted as a solicitor of the Supreme Court of New South Wales. He is also a licensed strata manager.
Summary:
David outlined his history in the digital delivery in Strata systems and the challenges in maintain compliance. He emphasised that the use of technology is a bridge between dissemination of complex law and their practical use.
